It's really hard to decide, honestly. On the one hand, if money is raised for TDF and LibO we should be able to assure it goes where it is supposed to be, on the other hand, the local organizations of course need to be able to raise donations as well.

Maybe the basic rule is that money donated to TDF and LibO goes to the Foundation itself, but exceptions can be granted in case we know an organization?

I see it from the standpoint of the organization as well as from TDF - in Germany, we have a similar problem. Lots of money comes in to our nonprofit, but if we pass on every single cent, the nonprofit itself will not sustain (some people donate for the events we do, or for DVDs we give them). That's why we set up a dedicated account and PayPal to know what was donated for which purpose.

I've proposed that we write a charter with local associations, where when they earn money using our name, a percentage of this revenue is reversed to TDF. It could be a small amount for basis and if more, done as a donation. However it seems that nobody agree with this, but imho that would prevent TDF having less money that some local associations or strange things like the FR group sponsoring Alexandro's material :wink:

statutory and legal obligations - collecting a percentage of monies
raised by local associations for the use of TDF/LIbO trademarks could be
seen as trademark licensing in some jurisdictions, which may or may not
be permitted under law.

Sophie, I totally agree with you. Of course, we should be careful in writing the charter, but I think that we should have one association in each country able to organize local fundraising for TDF (as Wikimedia Foundation).

thanks for the hint - didn't take that into account.

IMHO, our trademark policiy is not officially in effect yet. What shall we reply to Daniel Gonzalez (who asked on the US marketing list) for now? Anyone has an idea?

My take is that temporarily, it is okay to use our logo, if they do not claim collecting on behalf of TDF. This however is only temporary, until our TM policy and a subsequent policy on fundraising is in effect.
